By whatever term it is called — bullying, harassment, intimidation, violence or overt incivility — hostile abusive behaviors are on the rise and take an increasing toll on the workplace. They often result in personal tragedy. Hostile behavior can occur off the job or electronically but still result in workplace trauma or violence.

 

There are so many types of hostile, intimidating offensive behaviors and so many applicable laws that it can seem difficult to define or deal with the scope of the problem. Some highly abusive behaviors appear not to be covered by any laws.  Can they be legally addressed? 

 

Your organization must stop this critical problem! The courts have expanded the scope of an organization's duty of care for the overall work environment. The U.S. Supreme Court has ruled that private and public organizations have a Duty of Care which is owed to both those they serve and to their employees. Any organization providing services to clients, patients, students and customers has Duty of Care obligations. The failure to pay attention to this Duty of Care can result in personal harm and legal liability for both the organization and for the individual. Adopting the Duty of Care immunizes organizations from liability and creates a healthy, productive profitable workplace.
