The Americans with Disabilities Act (ADA) and the significant amendments to the ADA in the Americans with Disabilities Act Amendments Act of 2008 (ADAAA) raise serious compliance challenges for employers. Failure to comply with the amended statute exposes employers to serious financial penalties. The ADAAA made important changes to the definition of the term "disability" by rejecting the holdings in several Supreme Court decisions and portions of the EEOC's ADA regulations. The effect of these changes is to make it easier for an individual seeking protection under the ADA to establish that he or she has a disability within the meaning of the ADA. But the amendments to the original law have not made compliance easier for employers. Employment law attorney Deirdre Kamber Todd will review the essential provisions of the ADA and the ADAAA, how the amended law has been interpreted by the EEOC and how best to comply with the law in this critical area.
