Pre-pandemic, telecommuting and flextime were the exceptions in the American workplace. Overnight, vast numbers of American employees became teleworkers. Next came the Family Friendly Coronavirus Response Act with its revolutionary introduction of paid sick leave and paid family leave, never before mandated by the federal government. Last but not least came the CARES Act with it liberal and generous unemployment and paycheck-protection provisions.
As state and local closure orders have been lifted and non-essential businesses reopened, a paradigm shift has occurred. In some localities, recurrence of COVID-19 mandated a two-steps-forward, one-step-back approach toward business as usual. Some firms found that many employees liked telecommuting and wanted to continue. Others realized that social distancing demanded that new schedules were called for. For example, one approach --- split team --- has some team members in the office, while others work from home, often with team members changing places every few days. Ensuring compliance with wage & hour requirements in this new normal may feel akin to herding cats.
