Inadequately checking the background of a prospective employee seems to have as many hazards for employers as does performing an improper or illegal background check. Performing inadequate or no background checks can result in claims of negligent hiring and reckless endangerment, but the subjects of an “improper” background check also have their legal recourse under the Fair Credit Reporting Act, discrimination laws and invasion of privacy cases. It also appears that both the EEOC and OFCCP are on the side of employees when there are charges of an improper background check. This has left employers wondering just how much freedom they really do have to weed out unqualified workers before they are hired, and what constitutes a “proper” background check. Get any of this wrong and your company could wind up in “hot water” with the employee, the EEOC, and the courts. That’s why it’s crucial that you understand what you can do when comes to performing background checks and checking references.
