The IRS and state governments are aggressively pursuing companies that misclassify employees. Misclassification of employees as independent contractors or interns can lead to audits, penalties, fines, back taxes, owed wages and overtime and costly enrollment in employee benefit plans. An organization can also be subject to negative publicity and the significant legal costs of defending government actions and lawsuits by workers who believe they should have been counted as employees.
