In 2016 the Wage and Hour Division, Department of Labor (WHD) and the IRS will be very interested in your payroll – who’s on it and who isn’t – and, who should be.
WHD has hired hundreds of inspectors to take a good look at organizations just like yours. And, in 27 states the WHD and IRS have entered into partnerships to combat employee misclassification (e.g., employees misclassified as independent contractors; nonexempt workers classified as being exempt). They do this through information sharing and coordinated enforcement. These enforcement efforts led them to collect more than $79 million in back wages in fiscal 2014.
